General Terms and Conditions

Section 1 Scope

These general terms and conditions apply to all contracts for the sale of horses and related services. Deviating terms of the buyer shall only become effective if we agree to them in writing.

Section 2 Offer and conclusion of contract

The presentation of horses on this website does not constitute a legally binding offer, but a non-binding invitation to make contact. A purchase contract is only concluded upon the signing of a written purchase agreement by both parties.

Section 3 Prices and payment

All prices are in euros. Unless otherwise agreed, the purchase price is payable in full before the horse is handed over. Ownership of the horse passes to the buyer only upon full payment of the purchase price.

Section 4 Pre-purchase examination

The buyer is expressly advised to have a veterinary pre-purchase examination carried out at their own expense before concluding the contract. The buyer has the opportunity to inspect and try the horse before purchase.

Section 5 Handover and transfer of risk

Handover generally takes place at our farm. Risk passes to the buyer upon handover of the horse to the buyer or a person appointed by them. Transport and transport costs are borne by the buyer unless otherwise agreed.

Section 6 Warranty

The statutory warranty provisions apply. In sales to businesses, the warranty is limited to one year from handover. A horse is a living creature; natural variations in health, behaviour and performance do not constitute a defect.

Section 7 Liability

We are liable without limitation in cases of intent and gross negligence, as well as for injury to life, body or health. Otherwise, liability is limited to the foreseeable damage typical for this type of contract.

Section 8 Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

Section 9 Severability

Should any provision of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
